The existence of commercial courts and their role in creating good economic environment in the Republic of Serbia is more than significant, said the Minister of Justice, Nikola Selaković, today at the opening of 23th Symposium of commercial courts, organised by the Commercial Appellate Court and held from 7 to 10 September in Zlatibor.  

Selaković pointed out that the citizens as well as business entities do not fully trust the judicial system in Serbia and that one of the key reasons for this is long waiting time to reach a judicial decision. “You will often hear the citizens and business entities complaining of waiting for a judicial decision too long and asking for reaching the decision, whatever it is, within a reasonable time“ Selaković said.  

Regarding other reasons that the citizens have to distrust the judiciary are, as Selaković stated, the lack of expertise among judges and their fear of ignorance.

“In the incoming period, the Supreme Court of Cassation, Commercial Appellate Court, Judicial Academy and Ministry of Justice will pay much more attention to the continuing professional education of judges” Selaković said and added that, owing to the assistance of the World Bank, preparation of professional education of the bankruptcy judges has already been in progress. 

Selaković pointed out that the judges are to a large extent right when talking about a frequent change in regulations and the problem of their application if the judges did not participate in their adoption. “The Ministry of Justice will insist in the future that the judges participate in creating regulations to be adopted by executive and legislative authorities” Selaković said and invited the judges to engage and get involved in the development of these regulations. 

Selaković reminded that the Ministry of Justice will also continue to invest in the judicial infrastructure and announced that, for the first time in the history of the commercial judiciary in the Republic of Serbia, he will build a building for the purposes of the Commercial Court in Užice.
